The balancing act ? every mother?s nightmare. Many days we feel like circus jugglers with more plates in the air than we can possibly handle. The summer adds to the insanity with the kids at home, swimming lessons to attend and numerous other distractions. Over the years, however, I?ve learned a few secrets that help me keep things in perspective:

Keep God First

In Matthew 6:33 we?re told to seek God?s kingdom above all else. Like the apostle Peter who saw Jesus walking on water and asked to join him ? as soon as we take our eyes off of Christ and begin to doubt, we sink.

In order to keep our eyes on Him, we need to be in relationship with Him. Schedule time in your day to read God?s Word and to talk with Him in prayer. Surround yourself with friends who love the Lord and who will point you back to Him when you struggle.

Don?t Be Afraid To Choose Family Over Business

As business owners, we do our best to maintain professionalism even when we?re working at our kitchen table with kids hanging on to our ankles. We have deadlines, client demands to meet and emails and phone calls to return. However, there comes a time in every work-at-home moms life when family simply must come first.

It may be that your child is struggling or it could be an extended family member in crisis. The point is, it?s ok to step away from your business when absolutely necessary. Be respectful ? let your clients know that you will be gone and when you plan to return. But don?t be afraid to set business aside for a time to be there for people who need you.

Plan Ahead

This is by far my biggest struggle. I?m a fly-by-the-seat-of-my-pants kind of girl. I love working from home because every day is different and, for the most part, I?m in control of what I do and when. However, when summer rolls around, there are vacations to take, sunny days to enjoy and kids needing attention. So, I?ve had to learn to plan ahead.

What works for me is to plot everything out weekly, giving each day a title for both home and business. So, Mondays are usually laundry days on the home front and ?clean out inbox? days for business. Tuesdays tend to be more relaxed with maybe a trip to the park or the swimming pool with some writing to be done in the early morning. Find what works for you and make the best possible use of your time.

Plan Time Off

Summertime is meant to be a more relaxed pace. Even if your family can?t afford to take a week off and fly to the beach (I wish!) you can still plan days off to do special things. We often take long weekend trips to nearby cities and do inexpensive things like visiting the historic areas of the city and playing sports like disc golf.

It may seem backwards, but with some extra effort you can turn this summer into a relaxing, enjoyable time. Make it a point to spend the quality with your family that you so often wish for (yep, I do that, too.).

Bankruptcy and Personal Injury Don't Mix | The Daily Legal

May 24, 2012 -- Despite difficult economic times, the American Bankruptcy Institute has noted the number of bankruptcy filings has dropped across the country. However, a recent opinion from the Illinois Appellate Court confirms that trial lawyers from both sides of the bar should be aware that bankruptcy filings can, and will, impact your case. In Berge, the First District found that the doctrine of judicial estoppel bars a plaintiff from proceeding with a cause of action in state court where the plaintiff fails to disclose the action as an asset in a bankruptcy petition. Berge v. Kuno Mader and DMG America, Inc., 354 Ill.Dec. 374, 957 N.E.2d 968 (1st Dist. 2011).

Plaintiff, Shirley Berge, was involved in a car accident in May 2006 with a car owned by DMG America (DMG) and driven by DMG's employee. She filed a negligence complaint for the accident in state court in November 2007. One month prior to the accident, Berge filed for chapter 13 bankruptcy and later converted the chapter 13 bankruptcy petition to a chapter 7 petition. In October 2009, Berge received a "no assets" discharge of her debts in bankruptcy court and her chapter 7 petition was closed and fully resolved.

DMG independently discovered that the plaintiff had filed bankruptcy and filed a motion for summary judgment based on judicial estoppel for Berge's failure to disclose her negligence claim in bankruptcy court. It was undisputed plaintiff never disclosed the state court action to the bankruptcy court while her bankruptcy petition was pending. The trial court applied the doctrine of judicial estoppel and plaintiff appealed.

The plaintiff initially argued that the state court did not have jurisdiction because only the bankruptcy court can decide issues stemming from her bankruptcy filing. She additionally argued that a finding of bad faith surrounding her failure to disclose her case was required to apply judicial estoppel. While rejecting her arguments, the court noted that the state court decides whether it has or does not have jurisdiction in a particular case. Berge, 2011 IL App (1st) 103778 5. The court further noted that a finding of bad faith is not an element that must exist for courts to impose judicial estoppel. If it was, the court mentioned that her concealment of the state court case was sufficient for a court to infer bad faith because she had the potential to realize financial gain and had a duty to disclose the claim. Id. 6-7.

The law of judicial estoppel prevents a party who makes a representation in one case from taking a contrary position in another case. Judicial estoppel has five elements: (1) the two positions must be taken by the same party; (2) the positions must be taken in judicial proceedings; (3) the positions must be given under oath; (4) the party must have successfully maintained the first position and received some benefit thereby; and (5) the two positions must be totally inconsistent. Id. 12-13

The court found all five elements present in Berge's case. First, her pursuit of the state court action was contrary to her position in the bankruptcy court that she had no pending lawsuits. Second, plaintiff made the conflicting positions in separate judicial proceedings. Third, the positions were made under oath through her complaint and the representations made in her bankruptcy case filings. Fourth, the plaintiff's failure to disclose her case provided her the opportunity to recover a money judgment while permanently avoiding her debts. Lastly, the plaintiff did not disclose her lawsuit to the bankruptcy court while actively pursuing that claim in state court. Id. 14.

As a Chicago personal injury attorneys represent their client's on a contingent fee basis. Since the client is not required to pay a retainer fee his or her personal financial condition is not usually discussed. During the pendency of the injury lawsuit the client may seek the services of a bankruptcy attorney to discharge their debts. The problem is that neither attorneys knows of the others representation of the same client. The personal injury lawsuit never gets listed as an asset of the bankrupt estate and the court grants the debtor a discharge. With no debts the client then requests that the PI attorney settle the case. Money is pocketed by the client instead of being distributed to his or her creditors. The client has gotten away with bankruptcy fraud.

To avoid this inequity, the Illinois Appellate Court recently barred a personal injury action when the plaintiff failed to disclose the cause of action as an asset on their bankruptcy filing. In Shirley Berge v. Kuno Mader, 2011 IL app (1st) 103778. After being caught in the non-disclosure, the plaintiff attempted to amend her bankruptcy schedules. The court held:

"Allowing the plaintiff to easily remedy her situation would only serve to promote less than truthful asset disclosures with a hope of not getting caught and may have the effect of encouraging concealment of assets in bankruptcy"

The court utilized the doctrine of "judicial estoppel" to bar the plaintiff's cause of action. The primary focus of judicial estoppel in Illinois is purely on the actions of the litigant and its effect on the judicial system.

Personal injury attorneys must, ask their client about bankruptcy or conduct a brief search on PACER prior to meeting any potential client. The client must also be made to understand the importance of disclosing the lawsuit if he or she intends on filing bankruptcy subsequent to your representation. Finally, take the time to conduct some online research when defending a client or simply add the question to your interrogatories to the plaintiff.

Sweden, with its relatively inclusive attitudes to lesbians and gay men, would seem like a natural choice for gay expats hoping to live their identity more openly. But coming out is often more of an ongoing process than a point in time.

LGBT expats in Sweden experience the same difficulties as other immigrants with adjusting to Swedish culture, climate and maintaining relationships. But some aspects of the transition to Nordic life are often unexpected. it?s been suggested that the ?Law of Jante? has Swedes downplaying differences in favour of viewing everyone as equals. And living in a city such as Stockholm where being gay or lesbian is generally not regarded as anything unusual might also mean that it is harder to get acknowledgement of personal experiences of coming out as a gay man or lesbian. One way of getting this recognition is to speak to a counselling therapist who is understanding and supportive of gay identity.

Coming Out

Coming out as gay, lesbian, bisexual or transgender is often discussed as if it was an event. But it is more likely to be an ongoing process or something that continues through life. Some would say that we never stop coming out. Even in Sweden, we have a society where the heterosexuality is still the considered the norm and the assumption that a person is straight often goes unquestioned. This assumption is part of what has been called ?Heteronormativity?, a way of thinking that also suggests people fall into distinct genders (man and woman) associated with specific gender roles. The reality of life is, of course, quite different. Humans are as diverse as other species so biologically, sexually, gender-wise and with identity, there is much variation.

Making the decision to share your identity with others is a personal choice and needs to be treated as such. At the same time, the relief that often comes with inviting others into your life can often reduce anxiety and free up creativity. Talking about who you are and having an audience for your experiences is personally validating. Being able to be yourself around others can be one of the rewarding aspects of living in Sweden that might be harder to achieve in certain other places in the world.

Coming Out Later in Life / Gay and Married

For people who are older, coming out can be particularly challenging. I have spoken with many men who have decided, after years of marriage to a woman or having raised children, to explore other aspects of their sexuality and identity. Starting to identify as gay, bisexual or trans in your 40s, 50s or later can seem like entering a new world and an unknown world at that. If you are in this situation, it can be important to remember that you already know a lot about life even if the ?world? you are entering seems to have its own set of rules or conventions. Coming out after a straight relationship or later in life is a journey in itself. It can be helpful to have a gay counsellor to assist you to navigate the way forward.

Gay Relationship issues

Many of the people who consult with me at my practice at Fridhemsplan or online are going through couples counselling, have recently ended a relationship or are dealing with the aftermath of a break-up. It?s quite usual to have a difficult time when a relationship ends, and upset feelings can continue, especially when the end was unexpected or you had been with your partner for a long time. If you are gay, lesbian or transgender, it can be therapeutic to talk about the feelings and to find a way forward with the help of a professional.

For gay people, finding a partner in a ?heteronormative? world is not always easy. Investing in Gold as World Economies Falter

05/24/12 Laguna Beach, California ? Are you a civilized individual or a Neanderthal? Berkshire Hathaway?s Charlie Munger provides a simple litmus test? ?Civilized people don?t buy gold,? says Munger.

There you have it. If you possess absolutely no gold, other than maybe a tooth filling, you are civilized. Congratulations!

If, however, you?ve stashed a few Krugerrands under your mattress, we?ve got some bad news for you. You are hopelessly uncivilized ? a financial Neanderthal, deserving of pity from your civilized counterparts.

?I think gold is a great thing to sew into your garments if you?re a Jewish family in Vienna in 1939,? Munger remarked recently, ?but I think civilized people don?t buy gold. They invest in productive businesses.?

Yes, that?s right, Charlie. Civilized people invest in productive businesses?until an uncivilized government decides to steal it, or merely tax and regulate it into oblivion. Some Jews in Vienna in 1939 operated extremely productive businesses. Unfortunately, they could not stitch any of those into their garments.

In other words, Charlie, civilized investment strategies function in civilized societies. In uncivilized societies, gold is usually a better bet. Or to put it another way, as civilizations lose their civility, share prices fall and gold soars?which is exactly what has been happening here in our beloved US of A.

During the last decade and a half, the investment return of Berkshire Hathaway, perhaps the most civilized of American stocks, has trailed far behind that of gold. Civilized folks like Charlie Munger and Warren Buffett consider that 15-year trend a fluke. Maybe so. Or maybe this trend is a warning that America is becoming a bit less civilized ? a bit less friendly to productive businesses.

Notwithstanding this trend, civilized folks know better. They shun gold in order to invest in the shares of overhyped social media companies, highly leveraged banks, bonds of bankrupt governments and complex derivatives that are impossible to value precisely? until they go to zero? at which point their precise value is known.

That, Dear Reader, is civilized!

But there is one additional echelon: the ?ber-civilized investor. ?ber-civilized investors shun gold to invest in ?ber-complex derivatives. These are the folks like Warren Buffett who do not merely shun gold, but also belittle it very publicly while loading up on highly leveraged finance companies that are loaded up on complex financial derivatives.

Often, these banks are run by ?ber-?ber-civilized investors ? the kinds of guys who do not merely load up on complex derivatives, they load up on complex derivatives linked to the bonds of bankrupt governments. Then they utilize a ?risk control? methodology that has a perfect record of failing to control risk.

You just can?t get any more civilized than that.
